Website House Rules
ATTENTION: These rules (“Rules”) set out the terms for use of the current and any future discussion forums or weblogs that we may run on our Website or the FSID Facebook fan page (each a “Board”), which apply to all users. Any submission of material by you to any Board implies that you have read and understood these Rules and means that you accept, and agree to abide by, all the terms and conditions of these Rules.
With respect to our Website discussion forums and weblogs, these Rules supplement our terms of website use [www.fsid.org.uk/tandc] and our privacy policy [www.fsid.org.uk/privacy].
Please note: The FSID Facebook fan page is a public forum and we do not guarantee privacy or anonymity with regard to anything posted on the Facebook fan page, including via the wall. We are not liable for any detriment suffered by any individual through reliance on any material on the Facebook fan page. Our Privacy Policy does not apply to the Facebook fan page.
1. INTRODUCTION
1.1 The Board is operated by The Foundation for the Study of Infant Deaths (FSID) (“we”). We are registered as a charity in England under charity number 262191 and have our registered office at 11 Belgrave Road London SW1V 1RB.
2. MODERATION
2.1 Although we endeavour to moderate the Board on a daily basis, the Board is not fully moderated. We will not be responsible as author, editor or publisher of any material uploaded to the Board (a “Contribution”) and we expressly exclude our liability for any loss or damage arising from the use of the Board by any person in contravention of these Rules. We reserve the right to promptly remove, or to disable access to, any Contribution which we deem to be potentially defamatory of any person, unlawful or in violation of any third party rights.
3. USE OF THE BOARD BY MINORS
3.1 The use of the Board by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use the Board that it is important that they communicate with their children about their safety online. Minors who are using the Board should be made aware of the potential risks to them and of their obligation to comply with these Rules when using the Board.
3.2 We will do our best to assess any possible risks to minors from third parties when they use the Board, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks.
4. CONTENT STANDARDS
4.1 These content standards (“Content Standards”) apply to each part of a Contribution as well as to its whole. The Content Standards must be complied with in spirit as well as to the letter. We will determine, at our absolute discretion, whether a Contribution breaches the Content Standards.
4.2 You are responsible for the content of any Contribution you post. Where it relates to an existing discussion topic, note or comment, you should ensure that it is relevant, accurate (where it states facts) and genuinely held (where it states opinions) and be likely to prove useful to other members.
4.3 We do not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information contained in any Contribution. In using the Board you acknowledge that any reliance on any such opinion, advice, statement or information shall be at your own risk.
4.4 Please keep the content of Contributions on the topic of FSID, cot death, parenting, and related issues and do not use the Board to canvas views on other unrelated topics.
4.5 Please be polite and respectful towards other users of the Board and remember that others may not always share your point of view. Disruptive, offensive or abusive behaviour will not be tolerated. Cot death is a sensitive topic, and we reserve the right to take action on our own behalf or if requested to do so by another user.
4.6 In particular, you must be respectful of other people's feelings and differing values. Being someone who "speaks your mind" does not excuse a lack of consideration for others. Remember that communicating online is a somewhat impersonal medium, and your tone and body language will be lost, making the real meaning of your post open to misinterpretation.
4.7 Please consider other users at all times when making Contributions. Behaviour that deters other members from engaging with the community is considered offensive. Allow other users to contribute and do not dominate any discussions. Any complaints about users demonstrating such behaviour will be taken seriously.
4.8 A Contribution must not contain any advertising or promote any services or web links to other sites. We reserve the right to remove links and references to other organisations whose advice we feel contradicts our own.
4.9 When posting material on the Board, you are responsible for ensuring that all such material is free of any libellous or discriminatory statements of any form. We shall not be responsible for any such statements made by individuals on the Board and reserve the right to forward the contents to the appropriate professionals if any illegal activity is discussed on the page.
4.10 Furthermore, a Contribution must not:
(a) promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
(b) disclose the name, address, telephone, mobile or fax number, e-mail address or any other personal data in respect of any individual;
(c) breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
(d) be in contempt of court;
(e) be likely to harass, upset, embarrass, alarm or annoy any other person;
(f) impersonate any person, or misrepresent your identity or affiliation with any person;
(g) give the impression that the Contribution emanates from FSID if this is not the case;
(h) advocate, promote, incite any third party to commit, or assist any unlawful or criminal act; or
(i) contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
5. INTELLECTUAL PROPERTY
5.1 You must ensure that your Contribution does not infringe any copyright, database right or trade mark of any other person. Please ensure that any material you post that is not your own is either free of copyright or that you have received permission from the copyright holder to reproduce the material for these purposes. We shall not be responsible for any copyright infringement by individuals on the Board.
5.2 By submitting a Contribution to the Board, you agree to grant us a non-exclusive licence to use that Contribution. Although you will still own the copyright in your Contribution, we will have the right to freely use, edit, alter, reproduce, publish and/or distribute the material contained in your Contribution. This licence will be free of charge, perpetual and capable of sub-licence. We may exercise all copyright and publicity rights in the material contained in your Contribution in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material.
5.3 By submitting your Contribution to the Board, you are warranting that you have the right to grant us the non-exclusive copyright licence described above. If you are not in a position to grant such licences to us, please do not submit the Contribution to the Board.
6. BREACH OF THESE RULES
6.1 We reserve the right to take such action as we deem appropriate, at our absolute discretion, when we consider that a breach of these Rules has occurred. Failure to comply with these Rules constitutes a material breach of the terms of use on which you are permitted to use the Board.
6.2 Such action includes, but is not limited to:
(a) removing or editing any Contribution which does not adhere to these Rules, in particular, but without limitation, the Content Standards set out in these Rules;
(b) issuing a warning to you;
(c) withdrawal of your right to use the Board, on a temporary or permanent basis, in particular if you continue to behave in an unsuitable manner; and
(d) bringing legal proceedings against you.
6.3 We reserve the right to implement these actions without warning and without discussion with individuals posting on the Board. The actions described above are not limited and we may take any other action we reasonably deem appropriate.
6.4 We exclude our liability for any action we may take in response to breaches of these Rules.
7. COMPLAINTS OR CONCERNS
7.1 All issues or complaints regarding messages or actions on the Board should be emailed to our web team at office@fsid.org.uk.
7.2 We encourage anyone who is upset or confused by remarks, comments or advice on the Board to call the FSID Freephone helpline 0808 802 6868 or email helpline@fsid.org.uk.
8. CHANGES TO THESE RULES
8.1 We may revise these Rules at any time. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you.
